A town justice in Genesee County has resigned while under investigation for allegedly sending a court clerk inappropriate text messages.

According to the New York State Commission on Judicial Conduct, when the clerk asked Bethany Town Court Judge Joesph Nowakowski to stop, he allegedly retaliated by seeking to have her employment with the court terminated. In February, the Commission apprised Judge Mowakowski that it was investigating a complaint that he had sexually harassed a court clerk.

The Judge tendered his resignation by letter dated May 31st and officially vacated his office on June 1st. In his letter, Judge Nowakowski affirmed that he will neither seek nor accept judicial office at any time in the future.
