Two Facing Charges in Penn Yan After Nude Photos Sent to Harm Victim

Two Penn Yan residents have been arrested following ollowing an investigation into the dissemination of an intimate image of another individual.

An investigation into the matter by the Penn Yan Police Department revealed that Xavia Miller, 26, allegedly sent nude images of a victim to another person with the intent to cause emotional harm. Police also allege that Daniel Smith, 39, who is currently an inmate at the Yates County Jail, conspired with Miller to facilitate the crime.

According to investigators, Smith accessed the images and had Miller pick up a cell phone from another inmate’s property that contained the photos. Miller then allegedly disseminated the images to an individual known to the victim.

Miller was charged with Unlawful Dissemination or Publication of an Intimate Image. Smith was charged with Conspiracy in the Sixth Degree.

Both individuals were processed and held pending further court proceedings.
