Montezuma Man Charged with DWI

Cayuga County Sheriff Brian Schenck reports the arrest of 51-year-old Timothy Leary of Montezuma on August 17 following a traffic stop on Route 31.

Deputies say Leary’s vehicle was seen crossing the center line, and he was found to be intoxicated with open containers of alcohol inside the car. A breath test later showed a .23% BAC.

Leary was charged with DWI (first offense), aggravated DWI, and other traffic violations. He was issued tickets returnable to Montezuma Town Court.

The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
