The man accused of dousing a baby with lighter fluid at the Love’s Travel Stop in Tyre has decided to withdraw his guilty plea.
According to the Finger Lakes Times, Jamie Avery Jr. of Florida this week in Seneca County Court moved to withdraw his attempted assault plea. Avery faced nine years in prison on the charge.
Avery and Lisbeth Collado were arrested last May after setting several small fires inside the travel center.
The 1-year-old girl, and a 3-year-old boy found with a head injury in a tractor-trailer, are expected to make full recoveries.
The couple will be back in court next month to answer the charges.
