Court Upholds Disciplinary Action Taken Against Ontario Co. CO

An appeals court has upheld disciplinary action taken by Ontario County Sheriff David Cirencione against a correction officer once accused of eavesdropping at the county courthouse.

Correction Officer Adam Broadwell was suspended without pay for 30 days in 2023 after an internal investigation found he used a hearing device to listen in on jury deliberations. Although a grand jury cleared Broadwell of criminal charges, Sheriff Cirencione proceeded with disciplinary measures.

Broadwell challenged the suspension in court, but a panel of judges from the Appellate Division of State Supreme Court unanimously ruled the discipline was supported by substantial evidence—including testimony from a fellow officer. The court also rejected arguments that the punishment was excessive.

Broadwell, a former union president, has since returned to work at the county jail. Sheriff Cirencione told the Finger Lakes Times the matter is closed and that Broadwell continues to be a good employee.
